Obama-Romney debate challenge: handling the off-script moment

WASHINGTON (Reuters) - If history is a guide, Democrat Barack Obama will have a tough time in the first presidential debate on Wednesday, Republican Mitt Romney will be particularly aggressive, and both will risk committing a damaging gaffe if they wander off their talking points.

The 90-minute showdown in Denver - the first of three televised Obama-Romney encounters in October that will set the tone for the final month of the presidential campaign - will feature two experienced and competent debaters who are at their best in scripted settings.

Neither the Democratic president nor his Republican rival has ever seemed to enjoy the more freewheeling aspects of a candidates' debate, and both have said things during debates that became headaches for their campaigns.

Obama, known for soaring rhetoric and inspirational generalities in his speeches, suffered in some 2008 Democratic primary debates from a diffident and nuanced style that could make him seem flat and uncertain. His most pointed responses often seemed condescending or flippant.

Romney, who survived a grueling series of debates in this year's Republican race, often displayed an efficient and feisty style in rolling over his challengers.

But Romney also can seem stiff and awkward when challenged.

When frustrated, he can also make mistakes - like his offer to bet Texas Governor Rick Perry $10,000 over a disputed point during one Republican primary debate, a scene that was a reminder of critics' charges that Romney is an out-of-touch rich guy.

"They are pretty evenly matched as debaters," said Alan Schroeder of Northeastern University in Boston, who has written a history of presidential debates. "They both tend to be more intellectual than emotional, and they are both articulate and comfortable on camera. But they would both prefer to be in a more controlled setting."

The high-stakes debates - particularly the one on Wednesday, which will be moderated by PBS' Jim Lehrer and focus on domestic policy - could be the last chance for Romney to reclaim momentum from Obama.

The president leads his Republican rival in most national polls and in the politically divided "swing" states likely to decide the November 6 election.

Romney has taken frequent breaks from the campaign trail to practice for the debates, which could draw a television audience dwarfing the 30 million who watched his speech on the last night of the Republican National Convention last month.

The first of the three debates in the 2008 presidential race between Obama and Republican John McCain drew 52 million television viewers.

Debates rarely make a big difference in the final results of presidential races, but a strong performance can give a candidate a bump of a few percentage points in polls, said Mitchell McKinney, a political communications specialist at the University of Missouri.

"You don't normally see game-changer type moments in a presidential debate," he said. "But now the game is almost over, and this is Romney's chance. Can he take advantage?"

Both candidates are proven debaters, but have weaknesses that can be exploited, analysts said.

"If you are Romney, you want to figure out a way to get under Obama's skin, you want to see him get prickly," said Dan Schnur, an aide to McCain's 2000 presidential campaign. "If you're Obama, you want to be a little unpredictable and throw Romney off his script."

A CHALLENGE FOR OBAMA

Recent presidential debates suggest the first debate could be Obama's toughest.

Three of the last four incumbent presidents to seek a second four-year term - Ronald Reagan in 1984, George H.W. Bush in 1992 and his son George W. Bush in 2004 - suffered difficult first debates, although Reagan and the younger Bush won re-election.

The exception was Bill Clinton, a natural debater, in 1996. Clinton had defeated the elder Bush in 1992, and was a much sharper communicator than Kansas Senator Bob Dole, Clinton's Republican opponent in 1996.

"An incumbent president is used to having his way and being deferred to. He is not as used to being challenged," McKinney said. As a result, "they may come across as perturbed. Their job is to defend their record without becoming defensive."

That could prove tricky for Obama, who also will have to walk a fine line in acknowledging the nation's high unemployment rate and the economic difficulties faced by most Americans, while offering a more hopeful vision for the future.

During the 2008 debates, Obama sometimes sounded like the constitutional law professor he once was, exploring every angle of an issue in a rambling style. His staff says it is trying to curb those tendencies in debate preparations.

Obama was reminded of the danger of straying off message earlier this year when he punctuated a speech about the government help that business owners receive with the line, "You didn't build that."

Romney's Republicans called it an insult to business owners and made "We Did Build That" a theme not only of campaign commercials but the Republican convention.

Obama's most memorable 2008 debate gaffe came in what was widely viewed as an insensitive putdown of Democratic rival Hillary Clinton after a moderator questioned her likability.

"You're likable enough, Hillary," said Obama, who after his election appointed her as secretary of state.

Romney faces his own challenges on likability, and the trick for the former private equity executive will be to mount an aggressive attack on Obama without coming off as too cold, calculating or desperate.

"His problem is that people don't believe what he says," said Democrat Doug Hattaway, an aide in the presidential campaigns of Al Gore in 2000 and Hillary Clinton in 2008. "He delivers the lines fine, but the punches don't land the way they would if he was trusted more, so he comes off as more scripted."

During the primary debates, his offer of a $10,000 bet to Perry was not Romney's only out-of-touch moment.

During a debate in Nevada, he countered an attack on his use of a lawn service that employed illegal immigrants by saying that he had told the company, "I'm running for office, for Pete's sake, I can't have illegals."

ROMNEY'S GAFFE PROBLEM

On the campaign trail, Romney has unintentionally reminded voters of his wealth and privilege with comments about his friendship with NASCAR owners and his wife Ann's Cadillacs.

In what could be a turning point in the campaign, Romney was secretly recorded at a private fundraiser telling wealthy donors that the "47 percent" of Americans who do not pay taxes are "victims" who depend on the government for handouts and probably would never vote for him.

"Romney has shown a greater facility for gaffes and missteps, obviously," McKinney said.

Even so, Romney - who participated in more than 20 debates in the 2012 primaries and more than 15 during his unsuccessful run for the White House in 2008 - will be the most experienced presidential campaign debater ever to appear in a general election debate, McKinney said.

Romney will have far more camera time and a much bigger audience in a one-on-one debate with Obama than he did during the crowded primary debates. Analysts said he would need to articulate a sharper vision for the nation and avoid looking like he is merely trying to score debate points at every turn.

Gore learned that lesson the hard way in 2000, when he seemed to win the verbal jousting with George W. Bush but turned off viewers with his impatient demeanor and exasperated sighs when Bush was talking.

The Supreme Court returns to the bench on Monday to confront not only a docket studded with momentous issues but also a new dynamic among the justices.

The coming term will probably include major decisions on affirmative action in higher education admissions, same-sex marriage and a challenge to the heart of the Voting Rights Act of 1965. Those rulings could easily rival the last term?s as the most consequential in recent memory.

The theme this term is the nature of equality, and it will play out over issues that have bedeviled the nation for decades. ?Last term will be remembered for one case,? said Kannon K. Shanmugam, a lawyer with Williams & Connolly. ?This term will be remembered for several.?

The term will also provide signals about the repercussions of Chief Justice John G. Roberts Jr.?s surprise decision in June to join the court?s four more liberal members and supply the decisive fifth vote in the landmark decision to uphold President Obama?s health care law. Every decision of the new term will be scrutinized for signs of whether Chief Justice Roberts, who had been a reliable member of the court?s conservative wing, has moved toward the ideological center of the court.

?The salient question is: Is it a little bit, or is it a lot?? said Paul D. Clement, a lawyer for the 26 states on the losing side of the core of the health care decision.

The term could clarify whether the health care ruling will come to be seen as the case that helped Chief Justice Roberts protect the authority of his court against charges of partisanship while accruing a mountain of political capital in the process. He and his fellow conservative justices might then run the table on the causes that engage him more than the limits of federal power ever have: cutting back on racial preferences, on campaign finance restrictions and on procedural protections for people accused of crimes.

It is also possible that the chief justice will become yet another disappointment to conservatives, who are used to them from the Supreme Court, and that he will join Justice Anthony M. Kennedy as a swing vote at the court?s center. There is already some early evidence of this trend: in each of the last three terms, only Chief Justice Roberts and Justice Kennedy were in the majority more than 90 percent of the time.

?We all start with the conventional wisdom that Justice Kennedy is going to decide the close cases,? said Mr. Clement, who served as United States solicitor general under President George W. Bush. ?We?ve all been reminded that that?s not always the case.?

The texture of the new term will be different, as the court?s attention shifts from federalism and the economy to questions involving race and sexual orientation. The new issues before the court are concrete and consequential: Who gets to go to college? To get married? To vote?

First up
On Oct. 10, the court will hear Fisher v. University of Texas, No. 11-345, a major challenge to affirmative action in higher education. The case was brought by Abigail Fisher, a white woman who says she was denied admission to the University of Texas based on her race. The university selects part of its class by taking race into account, as one factor among many, in an effort to ensure educational diversity.

Just nine years ago, the Supreme Court endorsed that approach in a 5-to-4 vote. The majority opinion in the case, Grutter v. Bollinger, was written by Justice Sandra Day O?Connor, who said she expected it to last for a quarter of a century.

But Justice O?Connor retired in 2006. She was succeeded by Justice Samuel A. Alito Jr., who was appointed by Mr. Bush and who has consistently voted to limit race-conscious decision making by the government. Chief Justice Roberts, another Bush appointee, has made no secret of his distaste for what he has called ?a sordid business, this divvying us up by race.?

Justices Kennedy, Antonin Scalia and Clarence Thomas all dissented in the Grutter case, and simple math suggests that there may now be five votes to limit or overturn it.

The reach of such a decision could be limited by the idiosyncrasies of the admissions system in Texas. The university provides automatic admission to students in Texas who graduate in roughly the top 10 percent of their high school classes. That approach generates substantial diversity, partly because many Texas high schools remain racially homogeneous.

Ms. Fisher narrowly missed the cutoff at a high school whose students have above-average test scores for the state. She was rejected for one of the remaining spots under the part of the admissions program that considers applicants? race.

The court may uphold the Texas system under Grutter, or it may rule against it on narrow grounds by saying, for instance, that race-conscious admissions are forbidden where a race-neutral method ? like the 10 percent program ? can be said to be working.

But the court may also follow the health care ruling with a second landmark decision, this one barring racial preferences in admissions decisions altogether. Given persistent achievement gaps, even after controlling for family income, such a ruling would make the student bodies of many colleges less black and Hispanic and more white and Asian.

The court will probably also take on same-sex marriage. ?I think it?s most likely that we will have that issue before the court toward the end of the current term,? Justice Ruth Bader Ginsburg said at the University of Colorado on Sept. 19.

She was referring to challenges to an aspect of the federal Defense of Marriage Act, which bars the federal government from providing benefits to same-sex couples married in states that allow such unions. The federal appeals court in Boston struck down that part of the law, and both sides have urged the court to hear the case. More than 1,000 federal laws deny tax breaks, medical coverage and burial services, among other benefits, to spouses in same-sex marriages.

'We are now a very different nation'
The justices will also soon decide whether to hear a more ambitious marriage case filed in California by Theodore B. Olson and David Boies. It seeks to establish a federal constitutional right to same-sex marriage.

Chief Justice Roberts has not yet voted in a major gay rights case. Justice Kennedy wrote the majority opinions in both Lawrence v. Texas, a 2003 decision that struck down a Texas law making gay sex a crime, and Romer v. Evans, a 1996 decision that struck down a Colorado constitutional amendment that banned the passage of laws protecting gay men and lesbians. Most observers see him as the decisive vote in same-sex marriage cases.

The justices are also quite likely to take another look at the constitutionality of a signature legacy of the civil rights era, the Voting Rights Act of 1965. In 2009, the court signaled that it had reservations about the part of the law that requires the federal review of changes in election procedures in parts of the country with a history of discrimination, mostly the South.

?We are now a very different nation? than the one that first enacted the Voting Rights Act, Chief Justice Roberts wrote for himself and seven other justices. ?Whether conditions continue to justify such legislation is a difficult constitutional question we do not answer today.?

The chief justice seemed to invite Congress to revise the law, but lawmakers have taken no action.

Challenges to the law have arisen in several lawsuits in the current election season, including ones concerning redistricting and voter identification requirements.

?It will be interesting to see if the justices worry half as much about the emerging restrictions on voting as they worried about restrictions on political spending,? said Pamela S. Karlan, a law professor at Stanford.

On Monday, the new term will start with a case of great interest to business groups, Kiobel v. Royal Dutch Petroleum, No. 10-1491. The case was brought by 12 Nigerian plaintiffs who said the defendants, foreign oil companies, had been complicit in human rights violations committed against them by the Abacha dictatorship in Nigeria. The question in the case is whether American courts have jurisdiction over such suits, and business groups are hoping the answer is no.

In the last term, business groups achieved a series of victories, often by lopsided majorities. In cases with an individual on one side and business interests on the other, the court ruled for the business side 12 out of 14 times, according to calculations by Lauren R. Goldman, a lawyer with the firm Mayer Brown. In the two previous terms, the number of business cases was comparable, but individuals won at least half of the time.

Introducing himself to the nation at his confirmation hearings in 2005, Chief Justice Roberts said that ?judges are like umpires? in that they do not make the rules but merely apply them.

?Nobody ever went to a ballgame to see the umpire,? he said.

But the calls Chief Justice Roberts made in the health care case were surprising enough that it will be hard to look away. He voted with the court?s conservatives to say that the law was not authorized by Congress?s power to regulate interstate commerce and then joined the court?s liberals to say it was authorized by Congress?s power to levy taxes. No other justice joined every part of his controlling opinion.

Charles Fried, who served as solicitor general in the Reagan administration and filed a brief in support of the law, said the reasoning in the health care decision was mystifying enough to foreclose predictions about the future of the Roberts court.

?This is a court that under Chief Justice Roberts called a ball a strike, a strike a ball, but got the batter to base where he belonged,? said Professor Fried, who teaches at Harvard Law School. ?So who knows what to expect.?

The Musicians Union of Ghana (MUSIGA) has been asked to account for the GH?2 million (?20 billion) the Government of Ghana set aside in the 2012 budget to boost the creative arts industry.MUSIGA has gone for the money and is using it without the approval of other stakeholders in the creative arts industry and this has led to some bad blood between the union and other stakeholders in the creative arts industry.

The Music Council of Ghana (MCG) will be leading a delegation of music/creative arts stakeholders to present a petition to President John Mahama over the issue and also hit the streets on a demonstration meant to draw attention to the issue of the GH?2 million.

Reports reaching NEWS-ONE say MUSIGA is hot over the issue and has fallen on leading figures within the industry to call for a dialogue rather than demonstration.

On Wednesday, Ahuma Ocansey, popularly known as Daddy Bosco, was said to have represented MUSIGA at a meeting with the aggrieved stakeholders and pleaded for an amicable settlement of the matter.

Meanwhile, MUSIGA President Bice Obour Kufour is cooling off in New York, apparently absolutely unperturbed about the development.

A press statement signed by Justice Cletus ,general secretary, Music Council of Ghana noted: ?After waiting patiently for the Government through the Ministry of Chieftaincy & Culture to invite all stakeholders in the music/creative industry for appropriate disbursement of the GH?2, 000,000 budgetary allocation from the government of Ghana to the entire creative industry, we are indeed heartbroken and refuse to accept any such criteria or justification which warranted the total disbursement of this whole sum to one union of musicians called MUSIGA by the Ministry of Finance in collaboration with the Chieftaincy Ministry.

?MUSIGA does not represent the interest of the entirety of the Ghanaian Music/Creative industry and we don?t see any error or oversight that some may want to use to cover the role played by both the Ministries of Finance & Chieftaincy/Culture towards the processing and facilitation of this very questionable disbursement which His Excellency, the President of the Republic of Ghana has openly condemned and disassociated himself from the dubious payment of the said amount to MUSIGA.?

Not long after the budget was read, MUSIGA President Bice ?Obour? Kufour told several media houses that the money was for his musicians union alone and true to his words, they have hijacked the funds and left out all other stakeholders.

Speaking with Hitz FM, an Accra-based private radio station recently, ace hi-life musician Rex Omar, who is chairman of Business for MUSIGA, insisted that the money solely belonged to the musicians union, contrary to speculations.

According to him, ?MUSIGA applied for GH?2 million and it has been given to MUSIGA,? adding, if the money was meant for the creative industry, ?how come MUSIGA was able to access it and not the creative industry?

MUSIGA sent a specific proposal to do specific things?.

Meanwhile, the circumstances under which the Ministry of Finance released the money to MUSIGA alone are quite mysterious, especially when the Minister of Finance, in reading the budget statement, had categorically stated that the money was for the creative arts industry.

The Finance Minister, when he made the announcement, even went on to explain what he meant by the creative arts industry:

?Madam Speaker, Ghana has a vibrant creative arts industry that can be nurtured to create jobs and provide increase income to all stakeholders.

The industry covers creative sectors such as music, film video and photography, visual and performing arts, publishing, etc.

Global trade in creative goods and services remained very robust during the financial and economic meltdown, with the value of global export of creative goods and services reaching nearly US$600 billion between 2002 and 2008.?

?193. Ghana can benefit immensely if it begins to tap the creative sector of the economy, particularly those of the music and film industry.

But this will require an evaluation of the potential of the creative industry to contribute to the growth of the economy.

Beginning in 2012, therefore, Government will collaborate with the music industry to identify the potential of the industry through an impact assessment study.

The study will be used to support the preparation of a medium term strategic framework that will guide the development of the industry.

Government will also support the organisation of the 2012 Ghana Music Fair.

?194. An amount of GH?2.0 million has been allocated to support the creative arts industry in 2012,?was what Finance Minister Dufour told Parliament when he read the 2012 budget last year November.

Heineken nets Tiger beer in Asia drive

AMSTERDAM (AP) ? Heineken NV is spending another ?3.2 billion ($4.0 billion) to gain control over the Tiger beer brand as part of a strategy to significantly expand its operations in Asia.

Shareholders of Singapore-based conglomerate Fraser & Neave agreed Friday to sell their 39.7 percent stake in Asian Pacific Breweries, the owner of Tiger and other popular Asian brands, to Heineken.

After Friday's agreement and other recent share purchases, Heineken controls 95 percent of APB. In total, Heineken will have spent ?4.7 billion to boost its stake from 42 percent to 95 percent.

CEO Jean-Francois van Boxmeer said the company wanted "to move big and bold on the region, which is still a growth market for decades to come, for beer and premium beer."

Though Van Boxmeer conceded Heineken is paying a "full price" for APB, he said there were huge potential returns available, citing a forecast that the premium segment in China, in which Heineken and Tiger operate, will grow by 12 percent per year through 2020.

After the deal, which is being financed by debt, around 55 percent of Heineken's operating profits will come from "high growth" economies, he claimed.

Heineken also sees prospects for cross-selling Tiger beer globally, as beer drinkers have "appetite for something that is exotic, that comes from somewhere else."

Other APB-owned brands include Baron's Strong Brew, DB Bitters, ABC Extra Stout and Anchor. In Indonesia it brews Bintang, in New Zealand, Tui, and in Malaysia, "Guinness Anchor Berhad."

Heineken has owned part of APB via a joint venture with Fraser & Neave for nearly 80 years, but began working hastily to increase its stake in July. Heineken had to raise its bid for Fraser & Neave's stake to ward off a rival Thai bidder, and it also bought shares on the open market and from smaller stakeholders.

SNS Securities analyst Richard Withagensaid the deal is positive for Heineken.

"Heineken's initial bid for APB was already expensive, but even with the new higher offer, we still believe the deal to be compelling for Heineken from a strategic perspective," he said.

Heineken shares rose 1.3 percent to ?46.58.

Keeping it classy, Chicago Archbishop Francis George used a speech meant to celebrate the 50 year wedding anniversary of over 400 couples by blasting marriage equality.

Marriage "comes to us from God," rather than the government, he said, before using his Biblical perspective to lay out a discriminatory definition of the marital union: "Marriage is what it is, what Jesus said from the beginning: Two in one flesh, for which man leaves his family and joins himself to his wife; and wife leaves her family, and joins herself to her husband."

George went on to claim that equality-minded political leaders like Gov. Pat Quinn should be finding methods other than marriage to recognize same-sex relationships, the local CBS News affiliate reports:

There must surely be ways in our civil society, where we can honor friendships, where we can respect other people, without destroying the nature of marriage. It is very important, for your whole lives, give witness to what marriage truly means. And while civil laws might change????if they do ? then society will be the worse for it.

Priebus touts GOP fundraising advantage

Elkhorn - Reince Priebus, chairman of the Republican National Committee, said in an interview Saturday that the GOP has 10 times the amount of money in the bank ready to be spent on the presidential campaign compared with what the Democrats have.

Citing financial figures compiled by the GOP staff, Priebus said: "This was a great week. The RNC has $77 million in the bank and the Democrats have $7 million."

Priebus also predicted that Mitt Romney would become the first Republican presidential candidate to win in Wisconsin since 1984. He declined to say by how much he thought Romney would win by in the state.

"As long as get our 10 electoral votes and don't have a recount, I'm happy," said Priebus, the former chair of the state GOP.

He made the statements before speaking at the GOP First District Fall Fest at the Wiswell Center on the Walworth County Fairgrounds. The annual event had been scheduled to be outdoors.
